1. Agreement & Parties

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “user”) and WINGUARDIAN.NET LLC, a California limited liability company doing business as HWS.Center (“HWS.Center,” “we,” “us,” or “our”), governing your access to and use of hws.center and all associated services. You must be at least 18 years of age to use this site or make a purchase.

2. Account Registration & Security

To place an order, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and not share account credentials
• Promptly notify us of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to terminate accounts that violate these Terms or that we reasonably believe have been compromised.

3. Products, Availability & Pricing

We reserve the right to modify, discontinue, or limit the availability of any product at any time without notice. Prices are subject to change. In the event of a pricing error, we will notify you and give you the option to complete the order at the correct price or cancel for a full refund.

Product images are representative only. Actual product appearance, packaging, and formulation may vary. We are not responsible for typographical errors in product descriptions, though we make reasonable efforts to ensure accuracy.

4. Payment

All payments are processed through Stripe, a third-party payment processor. By submitting payment information, you authorize us and Stripe to charge your selected payment method for the total amount of your order, including applicable taxes and shipping fees. Your payment information is handled by Stripe in accordance with their security standards; we do not store your full card number on our systems.

All prices are displayed and charged in U.S. Dollars. You are responsible for any applicable taxes imposed by your jurisdiction.

5. Health Products — Important Limitations

Nothing on HWS.Center constitutes medical advice. You assume full responsibility for your decisions regarding the use of any products purchased through our platform. Consult a qualified healthcare professional before starting any new supplement or wellness regimen.

6. Intellectual Property

All content on hws.center — including but not limited to text, product descriptions, graphics, photographs, logos, the HWS.Center brand name, and software — is the property of WINGUARDIAN.NET LLC or its licensors and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this site without our prior written consent.

7. User-Generated Content

If you submit reviews, comments, photos, or other content to HWS.Center, you grant WINGUARDIAN.NET LLC a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, publish, and display that content in connection with our products and services. You represent that you own or have the right to submit such content and that it does not infringe any third-party rights.

8. Prohibited Uses

You agree not to:

• Use the site for any unlawful purpose or in violation of these Terms

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HWS.CENTER AND ITS PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WINGUARDIAN.NET LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, HWS.CENTER OR ANY PRODUCTS PURCHASED THROUGH IT. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, SO THE ABOVE MAY NOT APPLY TO YOU IN FULL.

11. Indemnification

You agree to indemnify, defend, and hold harmless WINGUARDIAN.NET LLC and its members, managers, employees, agents, and representatives from any claim, liability, loss, damage, or expense (including reasonable attorneys’ fees) arising out of your use of HWS.Center, your violation of these Terms, or your infringement of any third-party rights.

12. Auto-Renewal Programs

If HWS.Center offers subscription or auto-renewal programs, the following California disclosures apply pursuant to the California Automatic Renewal Law (B&P Code §§ 17600–17606):

• Subscription terms, pricing, and renewal frequency will be clearly disclosed before you complete your purchase
• Your payment method will be charged at the stated interval unless you cancel
• You may cancel at any time through your account settings or by contacting us — cancellation is as easy as sign-up
• You will receive a confirmation email with your subscription details

Specific auto-renewal terms will be disclosed at the point of enrollment for any such program.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under or relating to these Terms or your use of HWS.Center shall be resolved as follows:

• Informal Resolution: You agree to first contact us at legal@hws.center and attempt to resolve the dispute informally for a period of 30 days.
• Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules, with the arbitration conducted in California. The arbitrator’s award shall be final and binding.
• Exceptions: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or unauthorized use of confidential information.

14. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes via email or a prominent notice on our site before the changes take effect. The updated Terms will bear a new version number and effective date. Your continued use of HWS.Center after the effective date constitutes your acceptance of the revised Terms.
